Privacy Policy

In this Privacy Policy, ‘Geeta Pariwar’ 'us' 'we' or 'our' means Geeta Pariwar (a charitable society and trust duly registered under the Societies Registration Act, 1860 and the Bombay Public Trusts Act, 1950.) and its related entities or body corporates. This Privacy Policy explains the way we collect and store your information. By providing Personal Information or User Content to us, you consent to our collection, use and disclosure of your Personal Information in accordance with this Privacy Policy and any other arrangements that apply between us. We may change our Privacy Policy from time to time by publishing changes to it on our Platform. We encourage you to check our website periodically to ensure that you are aware of our current Privacy Policy.
Definitions
1.1 In this Privacy Policy, the following capitalised terms have the following meanings: Applicable Law means the data protection or privacy laws of the India applicable to Geeta Pariwar and the Users.
Automatic Data has the meaning given to it in Clause 2.3.
Classes means any online activities that we offer to Users through our Platform or through third party applications under the Program.
Geeta Pariwar Content means any content that Geeta Pariwar makes available for the Program on or through the Platform or Classes including course material, explanation material, information, instructional materials, stories, text, images, artwork, data, documents, sound recordings, lyrics, graphics, music, audio, video, certifications, or other proprietary content owned by Geeta Pariwar and any content licensed by Geeta Pariwar from a third party.
Instructors means the volunteers and other service providers, who conduct the Classes and provide other associated services for the Program.
Intellectual Property Rights means all intellectual property rights wherever in the world, whether registrable or unregistrable, registered or unregistered, including any application or right of application for such rights and includes copyright and related rights, database rights, confidential information, trade secrets, know-how, business names, trade names, trademarks, service marks, passing off rights, unfair competition rights, patents, petty patents, utility models, semi-conductor topography rights and rights in designs.
Non-personal Information means information which does not relate to a person and/or cannot be used to identify a person.
Personal Information means any information which can be used to identify an individual, and described in detail in Clause 2.
Platform means this website, app, platform and any service offered under the name “E-Sanskar Vatika”.
Program means the E-Sanskar Vatika program carried out through the Platform.
Students means the students who avail the Classes under the Program.
User Content means any content whatsoever which you upload to the Platform, including but not limited to any information, text, images, data, documents, feedback, comments, chats, questions, sound recordings, lyrics, graphics or any music, audio, or video.
2 What Personal Information do we collect?
2.1 Collection: We may collect Personal Information about you when you use the Platform, register on the Platform, participate in the Classes, or interact with us in any way in relation to the Program. You understand that the Classes are designed to give you access to a group of Students pursuing the same course and other Users participating in the same Classes (like co-Students and Instructors) will get access to your Personal Information such as name, phone number, etc. You hereby give your express consent to such disclosure.
2.2 Information you provide to us: We collect all information which Users voluntarily provide to us through using the Platform or interacting with us. This includes information provided:
  • during registration;
  • during correspondence, enquiries, support services, making payments, phone calls, or customer surveys;
  • in the course of availing the Classes;
  • uploaded onto the Platform in any way;
  • any chat text or other correspondence carried out via the Platform or during the Classes;
  • if you register to receive our newsletter,

The Personal Information we may collect includes without limitation:

  • basic information such as your first and last name;
  • contact information including email address and phone number;
  • demographic information such as postal code, age, and gender;
  • other relevant information (education, profession, and preferences);
  • geographic location;
  • login credentials for third-party websites;
  • other information obtained by your use of the Platform; and
  • any other information that enables Users to be personally identified.

2.3 Information we automatically collect: We also automatically collect certain technical data that is sent to us from the computer, mobile device and/or browser through which you access the Platform (“Automatic Data”). Automatic Data, includes without limitation, a unique identifier associated with your access device and/or browser (including, for example, your Internet Protocol (IP) address) characteristics about your access device and/or browser, statistics on your activities on the Platform, details of the products and services we have provided to you or that you have enquired about, including any additional information necessary to deliver those products and services and respond to your enquiries, or information about how you came to the Platform. However, to the extent that IP addresses or similar identifiers are considered Personal Information by local law, we also treat these identifiers as Personal Information. We collect Automatic Data based on your consent which was granted to us by you when you registered as a User and accepted this Privacy Policy. If you do not want us to collect this information, do not use the Platform or delete your account on the Platform.

2.4 Non-personal Information: When you interact with the Platform, we may collect Non-Personal Information. The limitations and requirements of this Privacy Policy on our collection, use, disclosure, transfer and storage/retention of Personal Information do not apply to Non-Personal Information. When you register for the Platform or otherwise submit Personal Information to us, we may associate other Non-Personal Information (including Non-Personal Information we collect from third parties) with your Personal Information. At such instance, we will treat any such combined data as your Personal Information until such time as it can no longer be associated with you or used to identify you.

2.5 Personal Information of Minors: Children under the age of 18 are not permitted to create their own Geeta Pariwar accounts without their Parents’ consent. If we learn we have collected or received Personal Information from a child under 18 without parental consent, we shall not be responsible for the consequences thereof and will delete that information without notice. If you believe we might have any information from or about a child under 18 which you have not permitted, please contact us.

3 Why do we collect, use and disclose Personal Information?
3.1 We may collect, hold, use and disclose your Personal Information for the following purposes:
  • to enable you to access and use our Platform and Classes, including allowing you to interact with other Users, such as Instructors whose Classes you are attending;
  • to operate, protect, improve and optimise our Platform, business and our users’ experience, such as to perform analytics, conduct research and for advertising and marketing;
  • to send you service, support and administrative messages, reminders, technical notices, updates, security alerts, and information requested by you;
  • to carry out our obligations and enforce our rights arising from the Agreement entered into between you and us, including for billing and collection.
  • to send you marketing and promotional messages and other information that may be of interest to you, including information sent by, or on behalf of, our business partners that we think you may find interesting; and
  • to comply with our legal obligations, resolve any disputes that we may have with any of our users, enforce our agreements with third parties and for anti-fraud purposes.

3.2 From time to time, we may use your Personal Information to send important notices, such as communications about Classes, and changes made to our terms, conditions and policies. Because this information is important to your interaction with Geeta Pariwar, you may not opt-out of receiving these communications.

3.3 We may also disclose your Personal Information to a trusted third party who also holds other information about you. This third party may combine that information in order to enable it and us to develop anonymised consumer insights so that we can better understand your preferences and requirements, personalise your experience and enhance the services that you receive.

3.4 The information we collect is not distributed, sold or leased to third parties for commercial purposes, except to provide services you have requested on the Platform or for other purposes when we have your permission or when we are obliged to do so.

3.5 We may disclose your Personal Information if we believe disclosure of your Personal Information is necessary or appropriate to protect the rights, property, or safety of Geeta Pariwar, our Users or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction. We limit our uses of data for anti-fraud purposes to those which are strictly necessary and within our assessed legitimate interests to protect our customers and our Services.

3.6 You are not obligated to provide the Personal Information that we have requested, but, if you chose not to do so, in many cases we may not be able to provide you with our products or services or respond to any queries you may have.

4 Do we use your Personal Information for direct marketing?
4.1 We and/or our carefully selected business partners may send you direct marketing communications and information about our Program and other services. This may take the form of emails, SMS, mail or other forms of communication, in accordance with the Applicable Law. By registering on the Platform and accepting this Privacy Policy, you hereby grant your consent to receiving such communications from us unless you opt-out as provided hereunder.


4.2 You may opt-out of receiving marketing materials from us by contacting us through the contact us feature below, or by using the opt-out facilities provided (eg an unsubscribe link).

4.3 We do not control third parties' collection or use of your information to serve interest-based advertising. However these third parties may provide you with ways to choose not to have your information collected or used in this way.

5 To whom do we disclose your Personal Information?
5.1 We may disclose Personal Information for the purposes described in this Privacy Policy to:
  • to other Users (such as Instructors, examiners, support staff, Students, as the context requires) in the course of providing and availing the Classes;
  • our employees and related bodies corporate;
  • third-party suppliers and service providers (including providers for the operation of our Platform and/or our business or in connection with providing our products and services to you);
  • professional advisers, dealers and agents;
  • payment systems operators (eg merchants receiving card payments);
  • our existing or potential agents, business partners or partners;
  • our sponsors or promoters of any competition that we conduct via our services;
  • anyone to whom our assets or businesses (or any part of them) are transferred;
  • specific third-parties authorised by you to receive information held by us; and/or
  • other persons, including government agencies, regulatory bodies and law enforcement agencies, or as required, authorised or permitted by law.
5.2 In certain circumstances, we may have to disclose certain Personal Information to third parties in order to administer or provide the services that you are requesting. Personal information will never be shared with third parties for their marketing purposes. For example, when you create an account with us, and request to join the Classes, you authorize us to share the information you provide with the Instructors while registering with us.

6 Using our Platform and Cookies

6.1 We may collect Personal Information about you when you use and access our website. While we do not use browsing information to identify you personally, we may record certain information about your use of our website, such as which pages you visit, the time and date of your visit and the internet protocol address assigned to your computer.
6.2 We may also use 'cookies' or other similar tracking technologies on our website that help us track your website usage and remember your preferences. Cookies are small files that store information on your computer, TV, mobile phone or other device. They enable the entity that put the cookie on your device to recognise you across different websites, services, devices and/or browsing sessions. You can disable cookies through your internet browser but our websites may not work as intended for you if you do so.
6.3 We may also use cookies to enable us to collect data that may include Personal Information. We will handle any Personal Information collected by cookies in the same way that we handle all other Personal Information as described in this Privacy Policy.

7 Data Security
7.1 We may hold your Personal Information in either electronic or hard copy form. We take commercially reasonable steps to protect your Personal Information from misuse, interference and loss, as well as unauthorised access, modification or disclosure and we use a number of physical, administrative, personnel and technical measures to protect your Personal Information. However, we cannot guarantee the security of your Personal Information.
7.2 The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Platform or the Classes, you are responsible for keeping such password confidential and not share it with anyone without our prior written consent. We are not responsible for circumvention of any privacy settings or security measures we provide.

8 Retention
8.1 We may retain your Personal Information as long as you are registered to the Platform as a User. You may close your account by contacting us. However, we may retain Personal Information for an additional period as is permitted or required under Applicable Law. Even if we delete your Personal Information, it may persist on backup or archival media for an additional period of time for legal, tax or regulatory reasons or for legitimate and lawful business purposes.

9 Exclusions
9.1 Links: Our Platform may contain links to websites operated by third parties. Those links are provided for convenience and may not remain current or be maintained. Unless expressly stated otherwise, we are not responsible for the privacy practices of, or any content on, those linked websites, and have no control over or rights in those linked websites. The privacy policies that apply to those other websites may differ substantially from our Privacy Policy, so we encourage individuals to read them before using those websites.
9.2 Personal Information provided to others: This Privacy Policy does not apply to any Personal Information that you provide or is disclosed by us in the course of the Classes to another User or visitor through the Platform or through any other means, including to Instructors or Students, or information posted by you to any public areas of the Platform or your social media profiles.
9.3 User Content: You may post content on the Platform or any other medium used for conducting the Classes, including your comments, feedback, pictures, and any other information that you would like to be available on the Platform in your own initiative. Although you may set certain privacy settings for such information by logging into your account profile, please be aware that no security measures are perfect or impenetrable. Additionally, we cannot control the actions of third parties with whom you may choose to share your User Content. Therefore, we cannot and do not guarantee that your User Content will not be viewed or used by unauthorized person that may violate this Privacy Policy, the law, or your personal privacy.

10 Accessing or correcting your Personal Information
10.1 You can access the Personal Information we hold about you by contacting us using the contact us feature below. Sometimes, we may not be able to provide you with access to all of your Personal Information and, where this is the case, we will tell you why. We may also need to verify your identity when you request your Personal Information.
10.2 If you think that any Personal Information we hold about you is inaccurate, please contact us using the contact us feature below and we will take reasonable steps to ensure that it is corrected.
10.3 We will consider and respond to all requests in accordance with all Applicable Law.

11 Intellectual Property Rights
11.1 Ownership: Except where otherwise indicated or implied by context, we are the sole owners or licensees of all Intellectual Property Rights comprised in the Platform, the Program and our services, including all Intellectual Property Rights comprised in the Geeta Pariwar Content and the technology and software underlying the Platform. Nothing in these Terms and Conditions constitutes a transfer of any rights, title or interest to the Intellectual Property Rights in or related to the Platform or Geeta Pariwar Content except for the limited, non-exclusive and non-transferrable license to: (i) use the Platform; and (ii) access and view any Geeta Pariwar Content made available on or through the Platform, solely for your personal and non-commercial use. All goodwill generated from the use of Platform, our services and/or the Intellectual Property Rights contained therein will inure to the exclusive benefit of Geeta Pariwar.
11.2 Proprietary Rights and Notices: You acknowledge and agree that the Platform and the Geeta Pariwar Content contained therein are protected by copyright, trademarks, service marks, patents, design registrations, and other proprietary rights and laws, and you agree to comply with and maintain all copyright notices and other restrictions on Geeta Pariwar Content accessed on or via the Platform. Our Platform may also contain our service marks or trademarks as well as those of our affiliates or other companies in the form of words, graphics, and logos. Your use of our Platform does not constitute any right or license for you to use our service marks or trademarks without the prior written permission of Geeta Pariwar.
11.3 Third Party Material: Certain reference documents, digital textbooks, articles, and other information on the Platform may be used and provided with the permission of relevant third parties, and use of that information is subject to certain rules and conditions, which will be posted along with the information. By using the Platform, you agree to abide by all such rules and conditions.
11.4 Your Conduct: You must not do anything which breaches or otherwise interferes with the Intellectual Property Rights of Geeta Pariwar or any of its third-party licensors. Except as expressly provided herein, Geeta Pariwar does not grant you any express or implied right or interest to use, copy, reproduce, modify, publish, share, transmit, or distribute any Geeta Pariwar Content without obtaining Geeta Pariwar’s prior written permission. Also, you may not copy Geeta Pariwar Content including course material or print them to sell to any person nor publish or print such material in any format including and not limited to the World Wide Web, CD, DVD, video, audio, newspaper, magazine, newsletter, bulletin or other method of distribution without express written permission from authorized Geeta Pariwar personnel.

12 Your Conduct
12.1 Necessary Conduct: In using the Platform and/or the Geeta Pariwar Content or participating in the Program, you must:
(a) always act courteously and politely to us and to any other User;
(b) strictly comply with the Terms and Conditions and any associated policy displayed on the Platform;
(c) obey all laws whatsoever (including domestic and international law, statutes, ordinances, and regulations) which may apply in respect of your use of the Platform and any Geeta Pariwar Content and participation in any Classes;
12.2 Prohibitions: In using the Platform or participating in the Program, you must not:
  • reproduce, modify, display, and exhibit Geeta Pariwar Content and/or incorporate Geeta Pariwar Content in other works in any media, form, or technology now known or later developed;
  • take any action that is likely to impose upon the Platform or us (or our third-party suppliers) a disproportionately large load;
  • interfere with the proper working of the Platform, Classes or any activities conducted via the Platform, including by using any automated or manual software or process to "crawl", "spider" or engage in similar conduct in relation to the Platform;
  • reverse engineer or otherwise seek to obtain any source code forming part of the Platform;
  • collect or retain any personally identifiable information contained in the Platform;
  • stalk, harass, bully or harm other Users;
  • access the Platform or the Classes by any means other than authorised herein;
  • impersonate any person or entity or otherwise misrepresent yourself or your affiliation with any person or entity;
  • develop a competing Platform or program; or
  • advocate, encourage, or assist any third party in doing any of the foregoing.
12.3 We reserve the right to refuse to assign you a Class, or allow you to participate in the Learn Geeta Program on suspicion of unauthorised, fraudulent or otherwise unlawful use of the Platform. Where this occurs, your account will be cancelled.

13 Disclaimer and Limitation of Liability
13.1 WE ARE NOT RESPONSIBLE OR LIABLE IN ANY MANNER FOR ANY CONTENT POSTED ON OUR PLATFORM, WHETHER POSTED OR CAUSED BY US OR BY THE USERS OF OUR PLATFORM. WE ARE NOT RESPONSIBLE FOR THE ONLINE OR OFFLINE CONDUCT OF ANY USER OF OUR PLATFORM.
13.2 UNDER NO CIRCUMSTANCES WILL GEETA PARIWAR BE RESPONSIBLE FOR ANY LOSS OR DAMAGE, INCLUDING ANY LOSS OR DAMAGE, PERSONAL INJURY, OR DEATH RESULTING FROM ANYONE’S USE OF OUR PLATFORM, PARTICIPATION IN THE PROGRAM OR ANY INTERACTIONS BETWEEN USERS OF OUR PLATFORM, WHETHER ONLINE OR OFFLINE. GEETA PARIWAR CANNOT GUARANTEE AND DOES NOT PROMISE ANY SPECIFIC RESULTS FROM THE USE OF OUR PLATFORM.
13.3 WE EXCLUDE ALL LIABILITY AND ALL WARRANTIES (EXPRESS, IMPLIED OR OTHERWISE) UNDER THESE TERMS AND CONDITIONS INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT TO THE MAXIMUM EXTENT PERMITTED BY LAW, WITH THE EXCEPTION OF MANDATORY WARRANTIES PURSUANT TO ANY APPLICABLE LAWS. ALSO WE MAKE NO WARRANTY ABOUT THE ACCURACY, COMPLETENESS, TIMELINESS, OR QUALITY OF THE PLATFORM OR ANY COURSES OR CONTENT OF THE PROGRAM, OR THAT ANY PARTICULAR COURSES OR CONTENT WILL CONTINUE TO BE MADE AVAILABLE.
13.4 WE PROVIDE THE PLATFORM ON AN “AS IS” AND ON AN “AS AVAILABLE” BASIS WITHOUT ANY WARRANTIES AS TO CONTINUOUS, UNINTERRUPTED OR SECURE ACCESS TO THE PLATFORM, THAT ITS SERVERS ARE FREE OF COMPUTER VIRUSES, BUGS OR OTHER HARMFUL COMPONENTS, THAT DEFECTS WILL BE CORRECTED, OR THAT YOU WILL NOT HAVE DISRUPTION OR OTHER DIFFICULTIES IN USING THE PLATFORM. YOU SHOULD EXERCISE CAUTION IN THE USE AND DOWNLOADING OF ANY SUCH CONTENT OR SOFTWARE AND USE INDUSTRY-RECOGNIZED SOFTWARE TO DETECT AND REMOVE VIRUSES. ALL RESPONSIBILITY OR LIABILITY FOR ANY DAMAGES CAUSED BY VIRUSES SOMEHOW ATTRIBUTED TO OUR PLATFORM IS DISCLAIMED.
13.5 OUR LIABILITY ARISING IN CONNECTION WITH THESE TERMS AND CONDITIONS OR THE PLATFORM IS LIMITED AS FOLLOWS:
(a) WE EXCLUDE ALL LIABILITY FOR CONSEQUENTIAL, SPECIAL, INDIRECT, NON-ECONOMIC OR REMOTE LOSS, INCLUDING LOSS OF OPPORTUNITY OR BUSINESS;
(b) OUR MAXIMUM TOTAL LIABILITY ARISING IN CONNECTION WITH THESE TERMS AND CONDITIONS IS CAPPED TO RUPEES 1,000;
(c) OUR LIABILITY IS EXCLUDED TO THE EXTENT THAT YOU CONTRIBUTED TO THE LIABILITY;
(d) WE EXCLUDE ALL LIABILITY FOR ANYTHING YOU HAVE BEEN AWARE OF FOR LONGER THAN SIX MONTHS AND YOU HAVE NOT COMMENCED A CLAIM; AND
(e) OUR LIABILITY IS SUBJECT TO YOUR DUTY TO MITIGATE YOUR LOSS.
13.6 Reference to any products, services, processes, or other information by trade name, trademark, manufacturer, supplier, or otherwise does not constitute or imply endorsement, sponsorship, recommendation, or any affiliation with our Platform by third parties or by any of the equipment or programming associated with or utilized by our Platform.
13.7 In the event that we terminate the Platform or the Program or your access to the Platform or Classes pursuant to these Terms and Conditions, you release us from all liability, loss or claims suffered by you as result of or arising out of such termination.
13.8 If you are dissatisfied with any portion of the Platform or the Program, or with any of these terms, your sole and exclusive remedy is to discontinue the Classes and your use of the Platform.
13.9 All of the above subclauses of this clause 13 are separate and cumulative to one another and will survive termination.

14 Making a Complaint
14.1 If you think we have breached the Applicable Law, or you wish to make a complaint about the way we have handled your Personal Information, you can contact us using the contact us feature below. Please include your name, email address and/or telephone number and clearly describe your complaint. We will acknowledge your complaint and respond to you regarding your complaint within a reasonable period of time. If you think that we have failed to resolve the complaint satisfactorily, we will provide you with information about the further steps you can take.
